Terms of sale and licence
What you are buying, what you may do with it, and what I am promising. Written to be read rather than to be survived.
These terms apply to every purchase. The terms that govern a purchase are the ones on this page on the day it is made.
1. Who you are buying from
The software is licensed to you by Christer Söderlund, Mendelstraße 4, 13187 Pankow, Berlin, Germany. The full provider identification is in the Impressum.
The sale itself goes through Paddle, who are the merchant of record and the seller of record for your purchase. That means the name on your card statement and on your invoice is Paddle's, not mine. It is the correct name and not a mistake. Expect it on your statement.
2. What the licence gives you
You get a perpetual, non-exclusive licence to use Heimdall3D, in every host it runs in, for as long as you like, on any computer you personally work on. A desktop and a laptop is the normal case and it is fine. There is no activation, no seat check and no phone-home; the licence is verified on your own machine against a key you hold.
The licence covers the 1.x version line, including every update within it, at no further cost.
3. What it does not give you
- You may not share, publish, resell or sublicense your licence key. Your key carries your email address inside it and the plugin displays it, so a shared key is not anonymous.
- You may not redistribute the plugin itself, modified or not, or bundle it into another product.
- You may not remove or alter the licence check, and you may not use a key you did not buy.
Reverse engineering is permitted to the extent the law allows it regardless of what a licence says. In Germany that is §§ 69d and 69e UrhG. Nothing here is intended to claim otherwise.
4. Commercial and studio use
One licence covers one person, on as many machines as that person uses. Your desktop, your laptop and the machine you keep at the office are one licence, because they are one of you. A second person needs a second licence, whether or not you share a building.
There is no separate studio tier and no seat-counting server. A studio of six buys six
licences. The installer accepts a licence key on the command line
(/LICENCE=<key>), so rolling one out across a floor of machines is a single
line either way.
Commercial use is included. There is no separate commercial licence to buy, and nothing here restricts what you may do with the images you make.
5. What runs without a licence
Thumbnails, the preview pane and the viewer window run with no key and no account, in Windows Explorer, in Directory Opus and in the standalone viewer. There is no time limit on them. Four actions require a valid licence key: saving an image, copying a frame to the clipboard, writing a sprite sheet, and recording a turntable or an animation clip. Nothing is watermarked and no file of yours is altered at any point.
6. Updates and later versions
Updates within 1.x are included. A future 2.x would be a separate product at its own price; your 1.x licence keeps working on 1.x builds for as long as you want to run them. I am not promising updates for ever, and I would rather say that than imply it.
7. Warranty
If you buy as a consumer, your statutory warranty rights (Gewährleistung) apply in full and are not excluded or shortened by anything here.
Beyond those rights: the software is provided as it is. I do not warrant that it is free of defects, that it will work with every file you own, or that it will run on every combination of Windows version, Directory Opus version and graphics driver in existence. You can establish all three before you pay, because everything except the four export actions runs without a licence.
8. Liability
I am liable without limit for damage caused intentionally or by gross negligence, and for injury to life, body or health, and where liability is mandatory by law. That much is not negotiable and I am not trying to negotiate it.
For damage caused by ordinary negligence I am liable only where the breach is of an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely (a cardinal obligation), and then only up to the damage that is typical for a contract of this kind and was foreseeable at the time of purchase. Liability under the Produkthaftungsgesetz is unaffected. Nothing in this paragraph reduces the liabilities named above, which cannot be limited.
Independently of that: keep backups of your work. This plugin only reads your files, and it runs its GPU work in a separate process so a driver fault cannot take Directory Opus down with it. No software is a substitute for a backup.
9. Third-party software
Heimdall3D includes open-source components. Its About box names every one of them and its
authors, and gives the full path of THIRD-PARTY-NOTICES.md, which is installed
beside the plugin and holds each licence in full. The About box opens that file.
Directory Opus is a product of GP Software. This plugin is an independent third-party product and is not affiliated with, endorsed by or supported by GP Software.
10. Changes to these terms
The terms that apply to your purchase are the ones on this page on the day you bought. If they change later, that change applies to purchases made after it, not to yours.
11. Governing law
These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a business, the venue for any dispute is Berlin, my place of business.
If you are a consumer, none of that takes anything away from you. The mandatory consumer-protection rules of your own country of residence continue to apply, and you can still bring a claim where you live. A choice of law cannot remove protection the law of your home country gives you, and this one does not try to.
